LAKME SALON PRAGATI MOBILE APP SUPPORT INFO

Your use of the Lakme Salon Expert App (the “App”) and all features provided in the App are governed by the terms and conditions mentioned below (“these Terms”). By accessing or using the App, you agree to be bound by these terms. If you do not wish to be bound by these Terms please do not download the App or use the services of the App.

The App is owned or controlled by Lakme Lever Private Limited (“LLPL”). The term ‘Lakme Salon’ in these Terms refers to all salons run as ‘Lakme Salon’, Lakme FastnFab, Lakme Absolute Salon whether owned and / or operated by LLPL or a franchisee appointed by LLPL. The term ‘Expert’ in these Terms shall include employees employed for performing services in Lakme Salon employed by LLPL or any authorized Franchisee of LLPL. This App is made available only to Experts of Lakme Salon and no other persons. Other persons downloading the App would be unauthorized users and action as mentioned in these terms will be taken against such unauthorized users.

These Terms are subject to change from time to time. Hence, you are requested to refer to these terms from time to time on notice of change being given. Your continued use of the App will mean that You accepted and agree to the revisions.

Services of the App are available only in India and to persons resident in India.

1. You Profile & security:

You shall be responsible for maintaining the confidentiality of your Display Name and Password and preventing unauthorized access into your profile. You shall be responsible for all activities that occur under your Display Name. Expert shall only login using their personal registered mobile number and shall not use login credentials of any other Expert or third party. You agree that if You provide any information that is untrue, inaccurate, not current or incomplete, We shall have the right to indefinitely suspend or terminate or block access on the App.

You agree to:

• Provide and upload true and accurate details while using the App including profile image, name, nickname, date of joining, designation, salon name, contact details of the Expert.
• immediately notify Lakme Salon of any unauthorized use / breach of your password or account or where you have reason to believe that your account may be used in an unauthorized manner; and
• ensure that you exit from your account at the end of each session.
• Stop using the App, uninstall the app and immediately inform LLPL about your cessation of employment with Lakme Salon

The personal information / data provided to us by you during the course of usage of the App will be treated as strictly confidential and in accordance with the Unilever Privacy Policy, the App Privacy Policy and applicable laws and regulations. Please refer the Unilever Privacy Policy at http://www.unileverprivacypolicy.com/en_gb/policy.aspx  and the App Privacy Policy at _____ to understand how we use personal information.

2. Functionalities of the App:

The App provides a number of functionalities to Lakme Salon experts -

a. Appointments & Call Outs:

Experts can view the appointments allotted to them each day. It needs to be borne in mind that all details on the App are updated basis the appointment details updated in software solution like zenoti by respective salon manager. Experts can view customer details and the services to be rendered to the Customer. The Expert shall be updated through the App regarding Customer Call Outs to be made during the day.

b. Meeting Alert and Offers & Packages:

Experts shall receive updates and information regarding topics to be discussed, the Experts are expected to adhere to the guidelines provided through the App for each session. Further, Experts shall be updated regarding the current offers run by Lakme Salon and will be expected to communicate with the customers regarding such offers.

c. Glitterati:

• Glitterati Awards are performance linked reward scheme for the Experts in Lakme Network for encouraging their performance.
• Experts have to achieve minimum monthly target of Rs.1,00,000/- service sales in Big & Rs.60,000/- in Emerging salons is mandatory to qualify for Glitterati Awards.
• The Service sales achieved under “Hands & Feet” category will be doubled for the purpose of Glitterati Awards.
• Only Retail Sales billed in Zenoti will be considered.
• Top 500 Experts in Big & top 500 in Emerging salons will get their Glitters transferred to a Glitters Wallet which can be used after 2 quarters | For example - Glitters earned in MQ will be transferred to the Glitters Wallet by 15th April and can be redeemed from 1st Oct
• Glitters can be accumulated.
• Banking benefits & addition of Franchisee contribution/ doubling for COCO salons at end of year is discontinued.
• Bonus glitters (given for salon target achievement) will not be included for ranking purpose
• Experts found committing a SIN will not be eligible for Glitterati in the quarter. LLPL’s decision shall be final and binding with respect to any SIN committed by the Experts.
• Experts should report in case of any SIN which is beyond their control to the following email ID: ceo.lakmesalon@unilever.com
• It is hereby clarified that the Services booked in zenoti will only be considered for calculating Glitterati points. Experts will be able to view their Glitterati earned by them and others through the App.

d. MAGIC MOMENTS :

LLPL shall share the winning Magic Moments on the App and the Experts shall be free to post their comments and react to the posts on the App. Experts shall take the consent of every customer before uploading the personal, sensitive data on the app.

e. Individual Development Plan :

The Development Plan for each Expert will be updated under the IDP tab and the Experts performance shall be evaluated basis the development plan shared through the App. For Experts of Franchise Lakme Salon, the IDP will be shared by such appointed Franchisees of Lakme Salon and shall be updated on the App only upon receipt of such IDP details from Franchisees. LLPL shall not be held responsible for tracking the performance and providing professional recognition by way of incentives or in any form for Experts of Franchise Lakme Salon. In the App, IDP is only for the purpose of providing recommendations to enhance their performance for the current year.

e. Your Use of the App :

You agree, undertake and confirm that your use of the App shall be strictly governed by the following binding principles:

• Information shared at your end is not false, inaccurate or misleading in any way; does not infringe upon or violates any third party's rights including, but not limited to, intellectual property rights, rights of privacy (including without limitation unauthorized disclosure of a person's name, email address, physical address or phone number) or rights of publicity; does not interfere with another user's use and enjoyment of the App or any other individual's User and enjoyment of similar services; does not violate any law for the time being in force
• You shall not send/post illegal, offensive (including sexually explicit content or which promotes racism, bigotry, hatred or physical harm), deceptive, misleading, abusive, indecent, harassing, obscene, pornographic or menacing or otherwise unlawful material in any manner whatsoever; or which consists of or contains software viruses or any spam.
• You shall not use any false e-mail address, impersonate any person or entity, or otherwise mislead Lakme Salon by sharing multiple address and phone numbers or use the App with malafide intentions.
• You shall not attempt to gain unauthorized access to any portion or feature of the App, or any other systems or networks connected to the App or to any server, computer, network, or to any of the services offered on or through the App, by hacking, password "mining" or any other illegitimate means.
• You agree that you are responsible for all data charges you incur through use of the App.
• On termination of your employment with Lakme Salon, you shall discontinue use of this App immediately. LLPL may terminate these Terms at any time and may do so immediately without notice, and accordingly deny you access to the App. Such termination will be without any liability to LLPL. Upon any termination of these Terms by either you or LLPL, you must promptly destroy all materials downloaded or otherwise obtained from this App, as well as all copies of such materials, whether made under these Terms or otherwise. LLPL's right to any Comments, image or content posted on the App shall survive any termination of these Terms.
• You will be required to provide a valid phone number and / or e-mail address while using the App. We may contact you by e-mail, SMS, phone call or by sending notices on Mobile phone or by any other mode of communication. For contractual purposes, you consent to receive communications (including transactional, promotional and/or commercial messages), from us with respect to your use of the App.
• All comments, suggestions, graphics, ideas (including product and advertising ideas), and other information or materials you submit or update on the App to Lakme Salon through the App will become and remain the exclusive property of LLPL, including any future rights associated with such submissions, even if these terms and conditions are later modified or terminated. This means that you disclaim any proprietary rights in such submissions, and you acknowledge LLPL’s unrestricted right to use them (or materials or ideas similar to them) in any medium, now and in the future, without notice, compensation or other obligation to you or any other person. It also means LLPL has no obligation to keep your submissions confidential.
• Information published on the App is classified as Internal and Confidential. You understand that such information is subject to higher standards of care and caution. As such, you shall not under any circumstances share the Information made available to you under the App with any third party and share it strictly on need to know basis within the Lakme Salon network. All such information, including customer information that is provided to you under the App shall be used by you strictly for performing your duties at Lakme Salon and no other Purposes. LLPL and in certain cases the Franchisees reserve rights to take strict legal action for any misuse of Information made available under the App.

Unauthorized use of the App and its content :

Apart from the unauthorized use and access as captured at other places in these Terms below shall also be treated as gross violation and misuse of the App and its contents and for which LLPL and its parent company reserve the right to take appropriate action:

• Downloading the pictures, images, articles, content or any portion of it or copying or gathering through extraction tools or any other means for any commercial use or purpose or training.
• Reproduction, duplication, copying selling, visiting, distributing or otherwise exploiting this App or any portion of it for commercial purposes without the express consent of LLPL.
• Adopting similar or identically similar Trademarks as that of LLPL as appearing on the App, framing or use of framing techniques to enclose any trademark, logo, or other proprietary information (including images, text, page layout, or form) of LLPL and its parent company without express written consent.
• Use of any meta tags or any other "hidden text" utilising Lakme or Lakme salon or other trademarks without the express written consent of LLPL.

5 Consent :

The Experts by using this App, consent to collection, storage, processing and sharing of their personal and professional information including but not limited to details provided while logging into the App, other information collected and updated on the App during the Expert’s employment tenure with LLPL or Franchisees of LLPL. The consent provided herein is irrevocable and LLPL’s right over the data collected is sub-licensable, royalty-free and perpetual. Experts agree to waive any privacy rights they may have on this information. The Expert consents to receive communications in any form on the contact details provided in the App.

All copyright and other intellectual property rights in all text, images, sound, software and other materials on this site are owned by Lakme Lever Private Limited / affiliated companies or are included with permission of the relevant owners. References to affiliates or affiliated companies include all members of the Unilever Group*. As long as You comply with these Terms, we grant You a personal, non-exclusive, non-transferable, limited privilege to enter and use the App. You are permitted to download and use the App for non-commercial, informational and personal purposes only. No reproduction of any part of the site may be sold or distributed for commercial gain nor shall it be modified or incorporated in any other work, publication or site, whether in hard copy or electronic format, including posting to any other site or a social media. No other licence or right is granted

All trade marks displayed on this site are either owned or used under licence by Lakme Lever Private Limited. No rights are granted to you or any third party by allowing you to download the App.

All other trademarks not owned by LLPL or its affiliates that appear on this App are the property of their respective owners.

7 Reviews, Feedback, Submissions:

All reviews, comments, feedback, ideas, and other submissions disclosed, submitted or offered on the App or otherwise disclosed, submitted or offered in connection with your use of this App (collectively, the "Comments") shall be and remain the property of LLPL. Such disclosure, submission or offer of any Comments shall constitute an assignment to LLPL of all worldwide rights, titles and interests in all copyrights and other intellectual properties in the Comments. Thus, LLPL owns exclusively all such rights, titles and interests and shall not be limited in any way in its use, commercial or otherwise, of any Comments. LLPL will be entitled to use, reproduce, disclose, modify, adapt, create derivative works from, publish, display and distribute any Comments you submit for any purpose whatsoever, without restriction and without compensating you in any way. LLPL is and shall be under no obligation (1) to maintain any Comments in confidence;

(2) to pay you any compensation for any Comments; or (3) to respond to any Comments. You agree that any Comments submitted by you to the App will not violate this policy or any right of any third party, including copyright, trademark, privacy or other personal or proprietary right(s), and will not cause injury to any person or entity. You further agree that no Comments submitted by you to the App will be or contain libellous or otherwise unlawful, threatening, abusive or obscene material, or contain software viruses, political campaigning, commercial solicitation, chain letters, mass mailings or any form of "spam". LLPL does not regularly review posted Comments, but does reserve the right (but not the obligation) to monitor and edit or remove any Comments submitted on the App. You grant LLPL the right to use the name that you submit in connection with any Comments. You agree not to use a false email address, impersonate any person or entity, or otherwise mislead as to the origin of any Comments you submit. You are and shall remain solely responsible for the content of any Comments you make and you agree to indemnify LLPL and its affiliates for all claims resulting from any Comments you submit. LLPL and its affiliates take no responsibility and assume no liability for any Comments submitted by you or any third party.

8 Disclaimers, Indemnity & Release:

You shall indemnify and hold harmless LLPL, its subsidiaries, affiliates and their respective officers, directors, agents and employees of LLPL from any claim or demand, or actions including reasonable attorney's fees, made by any third party or penalty imposed due to or arising out of your breach of these Terms or any other policies referenced herein, or your violation of any law, rules, regulations or the rights of a third party.

You hereby expressly release LLPL and/or its affiliates and/or any of its officers and representatives from any cost, damage, liability or other consequence of any of the actions/inactions of Franchisees and specifically waive any claims or demands that you may have in this behalf under any statute, contract or otherwise in relation to acts or inactions

None of the provisions of these Terms shall be deemed to constitute a partnership or agency between LLPL and its franchisees. These Terms and the App is being provided by LLPL for Your benefit, being Experts of salons run under brand name Lakme Salon.

In case of employees of Franchisee Lakme Salon using the App, the provision of the App and its services shall not be deemed to have been provision under Employer – Employee Relationship. The Expert shall be beneficiary of the App which is being extended by LLPL to the employees of its Franchisees to optimize the benefits of the Business Systems of Lakme Salon to the Franchisee. The Relationship of LLPL and the Expert established by provision of this App shall be purely contractual. In case of employees of COCO salon of LLPL, the provision and utilization of the App shall be deemed to be one of the IT resources made available by LLPL to its employees to help them fulfill their duties under the contract of employment.

We further expressly disclaim any warranties or representations (express or implied) in respect of , accuracy, reliability, completeness, timeliness, performance, safety of the content on the App. While we have taken precautions to avoid inaccuracies in content, this App, all content,), software, products, services and related graphics are provided as is, without warranty of any kind. LLPL disclaims that any suggestions or tips provided through the App for enhancing the services provided by the Experts are in the form of recommendations only, their complete compliance does not guarantee any kind of professional incentive or recognition in any form or kind.

9 Objectionable Material:

You understand that by using this App or any services provided on the App, you may encounter Content that may be deemed by some to be offensive, indecent, or objectionable, which Content may or may not be identified as such. You agree to use the Site and any service at your sole risk and that to the fullest extent permitted under applicable law, LLPL and/or its affiliates shall have no liability to you for Content that may be deemed offensive, indecent, or objectionable to you

10 LLPL’s absolute rights & obligations in certain cases:

LLPL reserves the right, at its sole discretion, to change, modify, add or remove portions of these Terms, at any time without any prior written notice to you.

LLPL reserves all rights to discontinue the App or any of its features or upgrade or change it in any way it deems fit at any point of time without liability to the Experts or the Franchisees.

LLPL may suspend or terminate your use of the App if it believes, in its sole and absolute discretion that you have infringed, breached, violated, abused, or unethically manipulated or exploited any term of these Terms or anyway otherwise acted unethically. Notwithstanding anything in this clause, these Terms will survive indefinitely unless and until LLPL chooses to terminate them Upon any termination of these Terms by either you or LLPL, you must promptly destroy all materials downloaded or otherwise obtained from this App, as well as all copies of such materials, whether made under these Terms or otherwise. LLPL's right to any Comments, image or content posted on the App shall survive any termination of these Terms.

LLPL reserves the right to refuse access of the App to anyone for any reason it deems fit to protect Lakme salon interests or interests of other users at any time.

Lakme Salon reserves the right to force forfeiture of any username for any reason as it deems fit to protect Lakme salon interests or interests of other users.

If You use any false e-mail address or use the portal for any unlawful and fraudulent purposes, which may cause annoyance and inconvenience and abuses any policy and rules of the company or mislead Lakme Salon by sharing multiple address and phone numbers or transacting with malafide intentions then Lakme Salon reserves the right to refuse access to the portal, terminate accounts including any linked accounts without notice to you.

Failure by LLPL to take an action on your beach of these Terms on any instance shall not preclude LLPL to take action in respect of the same or other subsequent breach at any other point of time.

LLPL shall not be liable for any failure to comply with its obligations caused by weather conditions, fire, flood, strike, hurricane, industrial dispute, war, hostilities, political unrest, riots, civil commotion, inevitable accidents, epidemics, pandemics, acts of God or any other circumstances generally amounting to Force Majeure (including the operation or disruption of the internet/ telephone systems).

LLPL shall also not be responsible for any loss or damage if it has to discontinue the App in compliance with any law, ruling, order, regulation, requirement or instruction of any Central/State Government or for any other unavoidable reason beyond its control. The participants shall be informed of such discontinuance/ cancellation at the earliest.

None of the provisions of these Terms shall be deemed to constitute a partnership or agency between users and Lakme Salon and users shall have no authority to bind LLPL in any manner whatsoever;

Lakme Salon accepts no liability for any errors or omissions, whether on behalf of itself or any Third Parties;

The information provided on the app is for demonstrative purposes only. If there is any discrepancy between app data and official internal communication from LLPL, then official internal communication shall be prevailing over the app data.

LLPL shall not be liable in any manner whatsoever for the performance of the app across any operating system.

Notwithstanding anything to the contrary contained in this terms and conditions and any circumstances whatsoever, LAKME SALON shall not be liable for any incidental, ancillary, direct, indirect, special or consequential damages including but not limited to lost profits or injury or death, whether in contract or based on any theory of liability.

Disputes if any, shall be subject to Mumbai jurisdiction only.
